Terms of service

Avatar4i is operated by Tomryn Inc. (Ontario, Canada). By creating an account or using the service you agree to these terms. If you are using Avatar4i for an organisation, you confirm you are authorised to accept these terms on its behalf.

You must be at least 18 years old to create an account or use Avatar4i. Accounts believed to belong to anyone under 18 will be closed.

The following are prohibited without exception:

• • Impersonating any real person, living or dead.
• • Creating avatars or voices of minors, or content that sexualises minors.
• • Content intended to deceive, defraud, or defame anyone.
• • Political disinformation, including fabricated statements by public figures.
• • Any attempt to defeat voice-based or face-based identity verification or authentication.
• • Sexual, sexually explicit, or pornographic content.
• • Harassment, hate speech, threats, or incitement to violence.
• • Implying endorsement by a person or organisation without their written permission.

Avatar4i runs automated content safety checks on scripts and uploads. Blocked requests do not consume credits. Attempting to evade these checks is itself a violation.

You warrant that, for every image, video and voice recording you upload, you are either the person depicted or recorded, or you hold that person's explicit written permission to create an AI avatar or voice clone of them, and that the person is an adult.

You agree to indemnify and hold harmless Tomryn Inc., its directors and personnel against any claim, demand, loss or expense arising from material you upload or content you generate, including claims of infringement, misappropriation of likeness or voice, defamation, or breach of privacy.

You keep ownership of everything you upload and of the videos you generate. Tomryn Inc. claims no ownership of your videos and acquires no rights to them beyond the limited licence needed to operate the service: to store your files, transmit them to the AI providers that render your videos, and display them back to you.

We do not use your uploads or generated videos to train our own models, and we do not publish or license them to anyone else.

Generation is paid for with credits. Credits are a usage allowance, not currency, and have no cash value. They are non-refundable and cannot be transferred or exchanged.

Unused plan credits carry over while your subscription remains active and stay available in your balance; they are forfeited when the subscription ends or the account is closed, and expire in line with your plan terms. Credits included with a plan stop being granted as soon as the plan is cancelled.

Credits are reserved when a generation starts and charged when it completes. See pricing.

Output is produced by AI models and is provided as is. We do not guarantee the quality, accuracy, likeness fidelity, voice fidelity or suitability of any generated video, and generation can fail.

When a generation fails, the credits reserved for it are returned to your balance automatically.

Videos produced with Avatar4i are AI-generated. You are responsible for disclosing that wherever the law or a platform's rules require it.

Avatar4i depends on external AI providers for video rendering, voice synthesis, payments and hosting. Their availability, pricing, models and capabilities can change or be interrupted, and features may change as a result. We may substitute providers to keep the service running.

Paid plans are billed in advance, monthly or yearly, through Stripe, and renew automatically until cancelled. Prices may change with notice before your next renewal.

You can cancel at any time from Billing. Cancellation takes effect at the end of the current paid period; the service remains available until then. We do not provide pro-rated refunds for partial periods or for unused credits, except where required by law.

Failure to pay may result in suspension of paid features.

We may suspend or terminate an account that breaches these terms, in particular the acceptable use rules, with or without notice depending on severity. Content that violates those rules may be removed. You may close your account at any time.

The service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, Tomryn Inc. is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing here limits liability that cannot be limited under applicable law.

We may update these terms. Material changes will be reflected in the version and date below and, where appropriate, notified by email. Continued use after a change means you accept the updated terms.

These terms are governed by the laws of Ontario, Canada, and the federal laws of Canada applicable there. The courts of Ontario have exclusive jurisdiction over any dispute.
